CONDITIONS and terms of participation
1. General

These conditions apply to sailing trips on the "La Vela Rossa" (Reg. No. GE 8603 D) between the chartering person (hereinafter referred to as guest) and the chartering skipper (hereinafter referred to as provider). A charter without skipper is excluded. The chartering is carried out on the basis of the provisions of Art. 49bis Codice della nautica da diporto (so-called "noleggio occasionale") applicable in Italy; in this respect there is no commercial activity on the part of the provider.

Where possible, cruises shall be conducted under sail. If this is not possible due to the weather or wind conditions or towards the end of a trip, the trip will be motor-driven..


2. Registration, confirmation and cancellation

By the transmission of the registration by the guest no contract comes off yet. This requires the explicit confirmation by the provider. A claim to acceptance of the registration does not exist for the guest. The registration as well as its confirmation require the electronic form to its effectiveness. The trips take place if at least five persons are registered for the respective dates. In individual cases a trip can be carried out at the discretion of the provider even with fewer registrations. A claim to participation in the cruise expires without loss of the provider to the agreed remuneration if the guest is more than 15 minutes late. The provider reserves the right to cancel already confirmed registrations or to cancel already started cruises if the execution of the cruise would endanger the guests, the crew or the boat.


3. Safety regulations

The boat is licensed for a maximum of 10 persons (two persons crew and eight guests). However, for safety reasons, the total weight of the guests may not exceed 700 kg.

Instructions given by members of the crew of "La Vela Rossa" for safety reasons must be strictly observed.


4. Wind and weather

If it should rain at the beginning of the trip, it will be postponed to the next possible date. If the wind is too strong at the beginning of the trip, the time of departure and arrival may be delayed. If there is no wind for a longer period during the trip, the duration of the trip will be extended on request and if possible due to subsequent dates at no extra charge. If the trip has to be terminated prematurely due to excessive wind conditions, the guests will receive a proportional refund of the costs.


5. Minors guests

For minor guests, a trip is only possible when accompanied by a parent or guardian. Due to the special conditions of a sailboat, at least one accompanying responsible person per child under the age of six must take over the permanent supervision for reasons of safety.


6. Terms of payment

The costs for the participation in the trip are to be paid by the guest in cash at the latest immediately before the start of the trip. Cheque or credit cards cannot be accepted. Cashless payment is only possible if the full amount is credited to the account DE29602911200728403005 (GENODS1VBK) before the start of the cruise.


7. Disclosure of personal data

Due to legal requirements, the provider forwards personal data of the guests to the tax authorities and the coast guard. This is the following data: Name, address, date and place of birth as well as Italian tax identification number, or if none is available, the number of the identity card, as well as issuing authority and date of issue. In addition, the provider guarantees that the data will not be passed on to third parties.


8. Liability of the provider

The provider has taken out liability insurance with a sum insured of EUR 15,000,000 for personal injury and property damage (policy no. M12612730 with the insurance company ITAS MUTUA). The insurance company is liable for damages resulting from misconduct or breach of duty by the provider and asserted within a period of two years from the date of the damage event. Any liability going beyond this insurance cover is excluded unless the damage was caused intentionally.


9. Other

Due to official regulations there is no sale of drinks or food on board. Guests may, however, bring these with them.

Guests are requested to wear suitable shoes. For safety reasons, these should be as flat as possible and must have sufficient slip resistance even in wet conditions.

Pets up to the size of a medium-sized dog are possible on board only with the booking option "whole boat" and after consultation.
